When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
Each individual user is permitted to maintain only one (1) account on the Service. Creating or attempting to create multiple accounts for the same person is strictly prohibited. Our system employs advanced behavioral detection to identify individuals attempting to create multiple accounts.
We recognize that legitimate shared networks (such as households, dormitories, schools, libraries, or businesses) may have multiple users accessing our Service from the same IP address. This is permitted as long as each account represents a distinct individual. However, we prohibit any single person from creating or maintaining multiple accounts regardless of whether different devices or IP addresses are used.
Any user caught attempting to circumvent this policy by creating multiple accounts will be subject to account termination without further notice. The system will preserve your primary account while removing additional accounts identified as belonging to the same individual.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lowercase letters, numbers, and symbols) with your account.
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Our Service and its original content, features, and functionality are and will remain the exclusive property of the website owner and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
You may provide content to the Service ("User Content"). By uploading any User Content, you represent and warrant that you have the right to upload such content and grant the licenses described herein.
Users are strictly prohibited from sharing or distributing any files downloaded from this site without explicit permission from the owner. Unauthorized distribution constitutes copyright infringement and may result in legal action.
You agree not to engage in any of the following prohibited activities:
Scraping, data mining, or any automated extraction of data from the website is strictly prohibited. Any user caught engaging in such activities will be prosecuted to the fullest extent of the law. This includes the use of bots, crawlers, or other automated tools to access, monitor, or copy any content from the Service.

Users are strictly prohibited from sharing their trade codes with others. Trade codes are intended for personal use only and must not be distributed to third parties.
Our trade bot system permits up to three (3) different Nintendo IDs to connect from the same account. This allowance is provided to accommodate users who own multiple Nintendo Switch consoles and wish to trade to each of them.
If a fourth (4th) different Nintendo ID attempts to connect using your trade code, your account will receive a warning. If a fifth (5th) different Nintendo ID attempts to connect, your account will be permanently banned from using the trade bot service.
This policy is strictly enforced to ensure fair access to our trade bot resources for all users.
Paid memberships are offered as recurring subscriptions billed through PayPal. By subscribing, you authorize PayPal to charge your selected funding source on the billing interval stated at checkout (typically monthly) until you cancel the subscription. Subscriptions automatically renew at the then-current price until cancelled.
We do not store your payment card details. All billing is handled by PayPal under PayPal's own User Agreement, which governs the payment relationship between you and PayPal.
All subscription payments are final and non-refundable. Our membership tiers deliver access to digital services (trade bot features, premium tools, and server resources) immediately upon activation. Because the service is consumed the moment you use it, we do not offer refunds, prorated credits, or partial-period reimbursements under any circumstances, including but not limited to: forgetting to cancel before the next billing cycle, using the service less than expected, account termination for violating these Terms, a specific feature or bot being temporarily unavailable, or simply changing your mind after subscribing.
By subscribing, you expressly acknowledge that the digital content and services provided are performed immediately, and you waive any statutory right of withdrawal or cancellation that may otherwise apply under your local consumer protection law, including the 14-day right of withdrawal under Article 16(m) of EU Directive 2011/83/EU on consumer rights, which expressly excludes digital content supplied with the consumer's prior express consent and acknowledgment of loss of withdrawal right.
Because subscriptions are billed directly by PayPal, you must cancel them through PayPal — we cannot cancel your PayPal billing agreement from our side. To cancel:
Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that period ends. No refund is issued for the remaining unused portion of the billing period.
Filing a chargeback, payment reversal, or PayPal dispute after receiving any portion of the paid service constitutes a material breach of these Terms. If you believe a charge is in error, you agree to contact us first at admin@genpkm.com and give us a reasonable opportunity to resolve the issue before initiating any dispute with PayPal or your card issuer.
Any user who files a chargeback, reversal, or dispute in violation of this section will be permanently banned from the Service (including all associated accounts), forfeit any remaining subscription time and associated account data, and may be liable for any fees, costs, and damages we incur in defending the dispute, including chargeback fees assessed by PayPal or the card network.
We maintain detailed records of each subscription purchase, including a hashed fingerprint of the exact Terms you agreed to, your IP address, browser, and timestamp at the moment of purchase, and server-side logs of the actions you took with the paid service. These records are submitted as evidence in any dispute.
Paid memberships grant access to the Service in its current form. We may add, remove, change, or temporarily suspend individual features, tiers, bots, or games at any time without notice and without obligation to refund. If a feature you relied on becomes unavailable, your sole remedy is to cancel future billing under Section 4.3.
Before you may complete a subscription purchase, you will be required to check a box affirming that you have read, understood, and agree to these Terms, and that you understand payments are non-refundable. By checking that box and clicking the "Subscribe" button, you form a binding electronic contract with us on the terms stated in this Agreement as of that timestamp, with the same legal force as a handwritten signature under the Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act as adopted in Alabama (Ala. Code § 8-1A-1 et seq.).
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, limitations of liability, and the no-refund and chargeback provisions of Section 4.
You agree to defend, indemnify, and hold harmless the website owner and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
These Terms shall be governed and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions. You and we agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Alabama, and you consent to the personal jurisdiction of those courts.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
